Prompt pack terms
Courtesy translation. The German text governs.
§ P1 Scope
(1) These terms apply to the purchase of digital prompt packs through atlasally.net between André Filipe Gomes Faria, trading as Atlas Ally, Schillerpromenade 10, 12049 Berlin, Germany (“Atlas Ally”), and the customer.
(2) Customers can be consumers (§ 13 BGB, the German Civil Code) or businesses (§ 14 BGB).
(3) Atlas Ally’s consulting services are covered by the separate terms at atlasally.net/terms.
§ P2 Service
(1) A prompt pack is a collection of text templates (“prompts”) for AI assistants, provided as two PDF files, one in German and one in English. The customer receives both files. The contents of each pack are set out in the description on the order page.
(2) The prompts are working templates. The customer checks the results of an AI assistant. Prompts on tax or legal topics do not replace tax or legal advice.
(3) The prompts were created with AI assistance and reviewed editorially by Atlas Ally.
§ P3 Formation of the contract
(1) The presentation of the pack on atlasally.net is not a binding offer.
(2) By clicking the link, the customer reaches the payment page of our payment provider Stripe. There the customer enters their details, confirms the statements in the checkbox, and makes a binding offer by clicking the order button. Until that click, the customer can check and correct their entries on the payment page, or cancel by closing the page.
(3) The contract is formed when the successful payment is confirmed on the payment page.
(4) The contract language is German. An English version is for information only.
(5) Atlas Ally does not store the contract text for the customer to retrieve. The customer receives the contract confirmation with these terms and the withdrawal information by email.
§ P4 Prices and payment
(1) All prices are final prices. Under § 19 UStG (the German small-business rule), no VAT is charged.
(2) There are no delivery or shipping costs.
(3) Payment is made in advance through Stripe, with the payment methods shown on the payment page.
§ P5 Provision
(1) Atlas Ally sends the pack as PDF files to the email address given with the order within 24 hours of receiving the payment.
(2) There are no delivery restrictions.
(3) If the customer does not receive the pack within this period, they contact support@atlasally.net.
§ P6 Right of withdrawal
(1) Consumers have a statutory right of withdrawal. Details are in the withdrawal information at atlasally.net/use-cases/withdrawal.
(2) The right of withdrawal expires once Atlas Ally has begun performing the contract, after the consumer has expressly agreed that Atlas Ally begins performing the contract before the withdrawal period ends, has confirmed that they know they lose their right of withdrawal through this consent once performance begins, and Atlas Ally has provided a confirmation under § 312f BGB (§ 356 Abs. 6 BGB).
(3) The consumer can also declare the withdrawal through the function “Withdraw from contract” (German: “Vertrag widerrufen”) at atlasally.net/withdraw-contract. The German page is at atlasally.net/vertrag-widerrufen.
§ P7 No subscriptions
The purchase is a one-time purchase. There are no recurring payments and no minimum term.
§ P8 Rights of use
(1) The customer receives a non-exclusive, unlimited-in-time, non-transferable right to use and adapt the prompts for their own purposes and within their own business, and to use them with AI assistants.
(2) Resale, passing the prompts on to third parties outside the customer’s own business, and publishing the prompts or the PDF files are not permitted.
(3) Results that the customer produces with the prompts belong to the customer.
§ P9 Liability for defects
The statutory rules on defects in digital products apply (§§ 327 ff. BGB). If a PDF file is unreadable or incomplete, Atlas Ally supplies a corrected file when notified at support@atlasally.net.
§ P10 Liability
(1) Atlas Ally is liable without limit for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act.
(2) For slightly negligent breach of an essential contractual obligation, liability is limited to the damage typical for this kind of contract and foreseeable. In all other respects, liability for slight negligence is excluded.
§ P11 Dispute resolution
Atlas Ally is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ P12 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers, this choice of law applies only so far as it does not remove the protection of the mandatory provisions of the state where they usually live.
